Heard learned counsel for the revisionist, learned AGA for the State and perused the record.
The present revision has been filed by the revisionist for quashing the judgment and order dated 15.1.2018 passed by Additional Sessions Judge, Court No.1, Firozabad in S.T. No.252 of 2016, under Sections 147, 148, 149, 307, 302, 504 IPC arising out of case crime no.100 of 2016 (State Vs. Jaipal and others).
It is contended by learned counsel for the revisionist that though the revisionist was named in the first information report. However, during investigation he was exonerated and now he has been summoned under Section 319 Cr.P.C. The trial Court has not appreciated the evidence on record in the light of the Judgmnet of Hardeep Singh Vs. State of Punjab (2014) 3 SCC 92.
I have perused the order of the trial Court. During trial the trial Court has taken into account the evidence on record.
I do not find any illegality or irregularity in the order of the Court below. The revision lacks merit and the same is accordingly dismissed.
It is provided that in case the revisionist appears or brought before the court concerned his bail application shall be considered and decided expeditiously strictly in accordance with law.
