Sri Tirath Raj Shukla, learned counsel for the applicant and Sri Shailendra Singh Rathore, learned A.G.A. for the State are present.
Counter affidavit filed by the learned AGA which is taken on record.
The present bail application has been filed by the applicant in Case Crime No.924 of 2015, under Sections 498A, 304B IPC and 3/4 of Dowry Prohibition Act, Police Station Sector 49, Noida District Gautam Budh Nagar, with the prayer to enlarge him on bail.
Having heard learned counsel for the parties and perused the record. Considering the fact that the deceased died within five months of her marriage at her matrimonial home and the applicant is husband of the deceased. He has not offered any explanation for her death.
Per contra learned AGA vehemently opposed the bail application of the applicant.
Without expressing any opinion on the merits of the case, I do not find it to be a fit case for grant of bail to the applicant.
The bail application is accordingly rejected.
However, it is submitted by learned counsel for the applicant that the applicant is in jail since 23.1.2016, the trial Court is directed to expedite the trial and conclude the same without granting unnecessary adjournment to either of the parties, on day to day basis, strictly in accordance with the provisions of Section 309(1) Cr.P.C., preferably within a period of four months from the date of production of a certified copy of the order.
Let a copy of this order be sent to concerned Court below for intimation and necessary compliance within a week.
