Heard learned counsel for the petitioner and learned standing counsel for State - respondents The limited relief prayed by the learned counsel for the petitioner is for a direction to the sub divisional Magistrate, Phoolpur, District Azamgarh, respondent no.2 to decide Appeal No. 21 of 2015 filed by the petitioner under section 6A of the U.P. Panchayatraj (maintenance of family register) Rules, 1970 within a fixed time frame.
On the aforesaid prayer, learned standing counsel has no objection.
Considering the facts and circumstances of the case, this writ petition is disposed of with the direction to the respondent no.2 to decide Appeal No. 21 of 2015 filed by the petitioner under section 6A of the U.P. Panchayatraj (maintenance of family register) Rules, 1970 in accordance with law expeditiously, preferably within a period of three months from the date of production of a certified copy of this order, if there is no legal impediment.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
