Mr.Pandya, learned APP waives service of notice of Rule for the State.
The present application is a successive bail application for suspension of sentence. On earlier occasion, this Court had already rejected such a prayer of the applicant - convict vide order dated 19th September, 2008 recorded in Criminal Misc. Application No.9560 of 2008.
Under these circumstances, the present application is not required to be entertained. However, since the appeal is of 2008, it is directed that the Registry shall expeditiously prepare the paper-book, preferably within three months and the appeal shall be listed for final hearing thereafter within one month.
Subject to the aforesaid observations and direction, the application is rejected. Rule discharged.
