Heard Sri Rohit Kumar Singh, learned counsel for the petitioner and Sri Ajeet Kumar Singh, learned Additional Advocate General assisted by Sri A.K. Sand, learned A.G.A. for the State-respondents.
This writ petition has been filed praying to quash the notice dated 08.09.2020 under Section 3(1) of the U.P. Control of Goondas Act, 1970 by the District Magistrate, Ghazipur.
Sri Ajeet Kumar Singh, learned Additional Advocate General states that the aforesaid notice has been withdrawn by the District Magistrate, Ghazipur by order dated 15.09.2021. He further states that the pond has been completely restored after due measurement, and minor encroachments found thereon, have already been removed. He further states that some encroachment of proprietor of M/s Balaji Garments was found over a banjar land, in respect thereof, proceeding under Section 67 of the U.P. Revenue Code has already been initiated which is likely to be concluded very soon, and, all steps shall be taken in accordance with law against the encroacher.
Learned counsel for the petitioner does not dispute the aforesaid statement of learned Additional Advocate General.
In view of the aforesaid statements of learned counsel for the petitioner and the learned Additional Advocate General as aforementioned, we find that no cause of action now survives in the present writ petition. Therefore, the writ petition is disposed off.
