Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed with a prayer to decide the release application filed by the applicant in respect to the Truck No. 52F/6535 in Case Crime No. 2 of 2018 (State Vs. Sadda, Husain) in Case Crime No. 313 of 2017, under Sections 419, 420, 406, 504, 506 IPC, Police Station Rudrapur, District Deoria, pending in the Court of Judicial Magistrate, Court No. 22, Deoria.
Learned counsel for the applicant submits that the applicant is the registered owner of truck bearing registration no. UP52F/6535 which is lying seized as case property in the aforesaid case. In this regard, the applicant has first filed an application for release of the vehicle despite certain applications having been filed by the applicant.
In view of the above, without going into the merits of the case the application is disposed of with the observation that the applicant files a fresh application for release of the aforesaid vehicle within a period of two weeks alongwith a certified copy of this order. Such application may be heard and decided by the learned Magistrate, expeditiously as possible, preferably within a period of four weeks from the date of filing of such application.
