The present Transfer Civil Miscellaneous Petition is filed by the wife-petitioner in the matrimonial proceedings.
2. The husband/respondent has filed the H.M.O.P.No.95 of 2014 on the file of the Sub Court, Dharmapuri, which is now sought to be transferred to Sub Court, Hosur.
3. It is the case of the petitioner/wife that there is a threat to her life at Dharmapuri by the respondent. It is also stated that because of the torture given by the respondent, she has become mentally disturbed and finds it difficult to travel alone to Dharmapuri. It is also stated that there is a matrimonial proceedings in M.C.No.10 of 2014 filed by the wife before the Judicial Magistrate No.II, Hosur and the respondent/husband has been attending the same. In such circumstances it may not be difficult for the husband to attend to the H.M.O.P. filed by him in Dharmapuri, if it is transferred to Hosur.
4. In spite of service of notice and the name of the respondent printed in the cause list, nobody appears.
5. In view of all the above, the H.M.O.P.No.95 of 2014 is transferred from the file of the Sub Court, Dharmapuri to the file of the Sub Court, Hosur. No costs. Consequently, connected Miscellaneous Petition is closed.
