Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The grievance of the petitioner is that their father had been granted a lease along with others. On its basis, he had been duly mutated. Proceedings for cancellation of the leases as regards two plots were initiated and as regards those two plots an order of cancelling the leases came to be passed.No orders were passed cancelling the lease of his father. While implementing the lease cancellation orders in the revenue records, the name of petitioner's father was also expunged.
It is contended that Section 38 of the U.P. Revenue Code, 2006 for correction of papers has been invoked by the petitioners for redressal of their grievance.
However, this Court finds that this application, if at all has been sent by Registered Post to the revenue authorities.
In my considered opinion, an application by registered post is not the proper manner for invoking Section 38 of the U.P. Revenue Code, 2006.
Petitioner, in case so advised, may file a proper application before the Tehsildar in the manner prescribed, invoking Section 38 of the U.P. Revenue Code, 2006 for correction of the revenue entries.
In case, a proper application is filed by the petitioners within 10 days from today, along with certified copy of this order, it is expected that the proceedings shall be concluded, as expeditiously, as possible.
Subject to the above, this writ petition stands, disposed of.
