Heard Sri Raj Kumar Ojha, learned counsel for the petitioner, learned Standing Counsel for respondents no. 1 to 7 and Sri Gaurang Saxena holding brief of Sri Amrendra Nath Singh, learned counsel for respondents no. 8 & 9.
The petitioner in the writ petition is seeking quashing of the order dated 7.11.2017 whereby his pension has wrongly been fixed.
Learned counsel for the petitioner submits that the petitioner may be given liberty to approach the respondent no. 5, Finance Controller, Directorate of Technical Education, Uttar Pradesh through a fresh representation.
The writ petition is, therefore, disposed of with a direction that if the petitioner prefers a fresh representation before the respondent no. 5, Finance Controller, Directorate of Technical Education, Uttar Pradesh raising his grievance as raised in this writ petition in respect of the impugned order dated 7.11.2017 along with a certified copy of this order within 15 days from today, the respondent no. 5 shall consider and decide the said representation within a period three months thereafter. The impugned order dated 7.11.2017 shall be subject to any final order which may be passed by the respondent no. 5.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
