This application under Section 482 of the Code of Criminal Procedure is filed against certain observations made by the learned J.M.F.C., Kapadvanj on 26.4.2006 by which note was taken about false deposition of the applicant herein.
Learned counsel for the applicant submits that the learned Magistrate has no jurisdiction to make such note about the deposition since it is a matter of evidence either it may be accepted or be rejected.
The matter is pending before learned Magistrate and no interference is called for by this Court at this stage in exercise of powers under Section 482 of the Code of Criminal Procedure.
In view of the above, this Criminal Misc. Application is rejected.
