Heard learned counsel for the plaintiff-petitioners and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioners have prayed for following relief:-
"(a). to issue a writ, order or direction to the respondent No.1/ Civil Judge (Senior Division) District- Bijnor to decide the stay application (6C) filed in O.S. No.- 41 of 2020 (Vijaya Gramin and another vs. Rakesh Kumar and another) expeditiously within a stipulated period as fix by this Hon'ble Court."
Considering overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid stay application (6C) filed in Original Suit No.- 41 of 2020 (Vijaya Gramin and another vs. Rakesh Kumar and another), strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of six weeks from the date of production of copy of this order.
It is provided that order available on the official website of the High Court will be taken to be authentic one.
