Heard Sri Ajit Kumar Singh Chauhan, learned counsel for the applicant and learned A.G.A for the State and perused the record.
This bail application has been filed on behalf of the applicant- Vijay Singh involved in Case Crime No. 261 of 2018, under Section 302 and 201 IPC, P.S. Puwayan, District Shahjahanpur Learned counsel for the applicant has submitted that the applicant is innocent and has falsely been implicated in the present case. He has no criminal history. The F.I.R has been lodged after two days of the occurrence. Co-accused Sakaran Singh has been granted bail by co-ordinate Bench of this Court. The dead body of deceased Parveen was recovered from his house whereof information was given by him. The applicant is in jail since 18.4.2018.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that naked dead body of deceased Parveen has been recovered from the house of applicant. The applicant Vijay Singh is named in the F.I.R. Ligature mark has been found around the neck of deceased. Death has been caused due to strangulation. The offence is very heinous. Hence, the applicant is not entitled to be released on bail.
Upon hearing learned counsel for the parties, perusal of record and considering the complicity of offence, role of applicant, severity of punishment as well as totality of facts and circumstances, at this stage without commenting on the merits of the case, I do not find it a fit case for bail.
The bail application of the applicant is rejected accordingly.
