Vijay Singh vs State Of U P And Others

High Court Of Judicature at Allahabad|22 February, 2019
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 35038 of 2002 Petitioner :- Vijay Singh Respondent :- State Of U.P. And Others Counsel for Petitioner :- Pradeep Verma Counsel for Respondent :- C.S.C.,Ajit Kumar Singh,N. Misra
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel and Sri Sashi Prakash Rai, Advocate, holding brief of Sri Ajit Kumar Singh, Advocate, are present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“(a) Issue a writ, order or direction in the nature of certiorari thereby setting aside he prolonged suspension of petitioner w.e.f. 31-3-1994 and also order of revocation of disciplinary proceedings held undealt against the petitioner for the last more than 8 years.
(b) Issue a writ, order or direction in the nature of mandamus directing the respondents to order reinstatement of petitioner in service w.e.f. 31-3-1994, treating entire period from 31-3-1994 to date of order of his superannuation on 15-4-2002, as duty and he be paid full salary, allowances and other such entitlements as admissible under the rules.
(c) Issue further writ, order or direction in the nature of mandamus directing the respondents to settle with retirement dues of the petitioner within a time-bound period of two months failing which the petitioner be allowed penal interest for the period of delay @ 18% per annum.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
