Heard Shri A.D. Singh, learned counsel for the petitioner and learned Standing Counsel for the State.
Learned counsel for the petitioner submits that he (petitioner) is defendant no.2 in a Suit No.75 of 2014, which is pending before the Civil Judge (Junior Division) Jaunpur. He further submits that in the suit, the plaintiff has already filed the application for dismissal of the suit on the basis of the compromise entered between the plaintiff and defendants No.2 and 3 and the said application was filed on 2.8.2017. However, till date, the said application has not been decided and the matter is lingering of.
Considered the submissions and perused the record.
The writ petition is disposed of with the direction to learned court below to decide the aforesaid application, expeditiously, preferably within a period of eight weeks from the date of receipt of a certified copy of this order, in accordance with law.
