1. Heard Mr. Deepak Kumar Jaiswal, learned counsel for the petitioner and Mr. Ravi Ranjan, learned counsel for the Power Corporation.

Learned counsel for the petitioner has confined his prayer seeking a direction to respondent no.2 (Executive Engineer) to restore the electricity connection in the premises of the petitioner by accepting the amount of electricity dues mentioned in the citation, in easy installments after adjusting Rs.50,000/- which has been deposited on 20.2.2021 (Annexure- 8).

Learned counsel for the Power Corporation states that against the amount of Rs.10,20,138/- as disclosed by the petitioner, the total amount due as on 23.10.2020, i.e. the date of permanent disconnection, is Rs.11,08,929/-. He further states that an amount of Rs.50,000/- has been deposited by the petitioner against the aforesaid amount claimed by the respondents. Thus, the amount outstanding as on date is Rs.10,58,929/-.

Mr. Jaiswal, learned counsel for the petitioner submits that, out of the outstanding amount of Rs.10,58,929/-, the petitioner is ready to deposit Rs.5,58,929/- within one month from today i.e. not later than 31.8.2021. The petitioner shall also furnish security for the balance amount of Rs.5 lacs in the shape of other than cash or bank guarantee to the satisfaction of respondent no.2.
5. Subject to the aforesaid deposit being made by the petitioner, the respondents may grant temporary re-connection to the petitioner without seeking any further deposit.
6. The balance amount Rs. 5,00,000/- shall be deposited by the petitioner in five equal monthly installments to be payable on or before 30.9.2021, 31.10.2021, 30.11.2021, 31.12.2021 and 31.1.2022 respectively.
7. The petitioner also undertakes to deposit the current electricity dues as and when they become due upon re-connection being granted.
8. Subject to deposit of the entire due amount as undertaken by the petitioner, the security furnished may be discharged.
9. In case of default of the conditions as mentioned above, present order shall automatically stand vacated and recovery proceedings shall revive from that stage.
