By impugned order dated 31.1.2018, the Principal Judge, Family Court, Mirzapur has allowed the application 3Aa and has set-aside ex-parte order dated 31.3.2017 passed in Case No. 13/2014 under Section 25 of the Guardians and Wards Act, 1890.
In the opinion of the Court, the order impugned is appealable under Section 19 of the Family Courts Act, 1984. Accordingly, this Court declines to entertain in the instant petition filed under Article 227 of the Constitution. The petition is accordingly dismissed with liberty to the petitioner to avail the remedy provided under the Act.
Certified copies of the order shall be returned to the counsel for the petitioner, in case an application in that regard is moved, after retaining photostat copy on record.
