Under an order dated 5th July, 2012, this Court while invoking the powers under Section 11 (6) of the Arbitration and Conciliation Act, 1996 appointed Hon'ble Mr. Justice V.K. Khanna, a retired Chief Justice of this Court as Arbitrator to resolve the dispute between the parties arising in connection with agreement No. 99-A/cs/Dy. CE/C/CNB dated 5th June, 2003. The Arbitrator appointed has refused to act as the Arbitrator. Hence, this matter is placed before the Court.
Having considered the facts stated above, it would be appropriate to accept the request of the Arbitrator to withdraw matters from arbitral proceedings and further to appoint Hon'ble Mr. Justice V.K. Chaturvedi, a retired Judge of this Court, resident of Ashok Nagar, Allahabad, as the sole Arbitrator in the matter. The sole Arbitrator shall be entitled for remuneration as per Fourth Schedule of the Arbitration and Conciliation Act, 1996.
Application is accordingly disposed of.
