Heard learned counsel for the parties.
By means of this application under Section 12 of the Contempt of Court Act, order of this Court dated 23rd July, 2019 passed in Writ petition no. 10530 of 2019 is complained of.
Learned Additional Chief Standing Submits that concerned authority was required to take a decision regrading relieving of the applicant on account of her proposed deputation that was consequential of the interview and selection held in respect thereof.
Learned Additional Chief Standing Counsel submits that competent authority has taken decision on 30th January, 2020 rejecting claim of the applicant, copy of which has come to be filed along-with compliance affidavit dated 07th February, 2020.
Learned counsel for the applicant submits that the order passed by learned Additional Chief Secretary is clearly unsustainable and claim of the applicant has not been considered in correct perspective.
In the considered opinion the court, the Writ Court has simply directed for consideration instead of granting relief to the applicant on account of selection for deputation in the operative part of the order it is clearly ordered by Writ court that authority shall accord consideration to the applicant's' claim and the applicant's claim has been accorded consideration by the order passed by the competent authority, however, petitioner is still aggrieved and takes plea that that the order passed by the authority concerned is not justifiable and unsustainable.
In the considered of the opinion of the Court, the applicant can approach appropriate forum for redressal of his grievance, if he is aggrieved aginst the order of competent authority. The cause of action for contempt no more survives. Notices issued, if any, stand discharged.
Contempt application is consigned to records.
