HON’BLE Ms. JUSTICE G.ROHINI Writ petition No. 14316 of 2010 Petitioner’s authorization as the dealer of the Fair Price Shop No.1513 of Suraram village of Elkathurthy Mandal, Karimnagar District was suspended by the proceedings of the 2nd respondent dated 20.03.2010 pending enquiry into the alleged irregularities in distribution of the commodities. Aggrieved by the same, the present writ petition is filed.
I have heard the learned counsel for the petitioner as well as the learned Government Pleader for Civil Supplies appearing for the respondents.
It is not disputed before this Court that on 20.03.2010 itself a show cause notice was issued by the 2nd respondent calling upon the petitioner to explain the alleged irregularities stating that the same would amount to contravention of Clause 5 (16) and 7 (i) of APSPDS Control Order 2008.
The petitioner states that he had already submitted his explanation on 29.03.2010 and the enquiry is still pending.
As the enquiry is pending before the 2nd respondent, though it is neither necessary nor proper for this Court to go into the merits of the case and express any opinion as to the correctness of the irregularities alleged against the petitioner, I deem it appropriate to dispose of the writ petition with a direction to the 2nd respondent to complete the enquiry pending against the petitioner pursuant to the show cause notice dated 20.03.2010 and pass appropriate orders in accordance with law as expeditiously as possible, preferably within a period of four weeks from the date of receipt of this order. In case, the enquiry is not completed within the time fixed above, the impugned order of suspension dated 20.03.2010 shall stand set aside and the petitioner’s authorization shall be restored.
Accordingly, the Writ Petition is disposed of. No costs.
