Heard learned counsel for the parties.
The petitioner is aggrieved against the order dated 09th August, 2018 on the ground that once he has been held to be senior most Assistant Teacher/Headmaster posted in Nyay Panchayat, Thathoi Block Gonda, District Aligarh, under the orders of District Basic Education Officer dated 31st July, 2018 there was no occasion for the District Education Officer to reopen the issue on the basis of some complaint.
Per contra, Sri Y.S. Bohra, learned counsel appearing on behalf of respondent nos. 2 and 3 states that no adverse order has been passed against the petitioner and the order of posting issued earlier is still intact. However, he contends, in the event any headmaster or teacher makes some complaint, the same can be examined by the authority concerned and mere examination thereof can not result in any prejudice to the petitioner.
It appears that 4th respondent who is complainant has made a complaint. The writ petition, therefore, at this stage is disposed of with direction that in event any enquiry is conducted as contemplated in the order dated 09th August, 2018, the petitioner shall be given proper opportunity of hearing before passing any final order in the matter.
Writ petition stands disposed of.
