Ms. Akansha Sharma holding brief of Mr. Manish Goyal, learned counsel for the respondent, on instructions, submits that the appeal (Annexure-9) has not been received in the Registry nor the memo of appeal has been forwarded from the District Judge, Moradabad, to the appellate authority.
In view thereof, learned counsel for the petitioner submits that he would submit the memo of appeal afresh through proper channel within three weeks from date.
In the event, such an appeal is submitted, it is expected that the same shall be considered and decided in accordance with law.
With the aforesaid observations, writ petition is disposed of.
