This application has been filed under Seciton 482 Cr.P.C. to quash the entire proceeding of Criminal Case No. 6006 of 2017 (State vs. Pappu Shukla & others), under Sections 452, 354, 323, 504, 506 IPC, Case Crime No. 295 of 2014, Police Station Bindaki, District Fatehpur pending in the Court of C.J.M., Fatehpur as well as the impugned Charge Sheet No. 105/2014, dated 19.05.2014 submitted in the aforesaid case.
Heard Sri Raghav Ram, learned counsel for the applicants and learned AGA for the State.
At the very outset without going into the merits of the case, learned counsel for the applicants prayed that the applicants are ready to surrender before the concerned Magistrate, as such, a suitable direction may be given for expeditious disposal of their bail application.
Learned AGA has no objection with the arguments contended by the learned counsel for the applicants.
In view of the above, the prayer made by the learned counsel for the applicants to quash the Criminal Case No. 6006 of 2017 (State vs. Pappu Shukla & others), under Sections 452, 354, 323, 504, 506 IPC, Case Crime No. 295 of 2014, Police Station Bindaki, District Fatehpur pending in the Court of C.J.M., Fatehpur as well as the impugned Charge Sheet No. 105/2014, dated 19.05.2014 is hereby refused.
However, it is provided that if the applicants appear or surrender before the Court concerned within thirty days from today and apply for bail in the aforesaid case, their prayer for bail shall be considered as expeditiously as possible by the court below in accordance with law.
With aforesaid direction /observation, the instant application stands disposed of.
