Heard learned counsel for the petitioner and Shri Vikram Bahadur Singh, learned counsel for the respondent No.2, 3 and 4 as well as learned Standing Counsel for the respondent No.1.
Due to medical reason, the petitioner-Ved Prakash Gupta, who is Headmaster in the Primary School run by the Basic Education Board, was attached to Primary School Aheripur-II, Block-Mahewa, District-Etawah and he has been functioning as such since 5.11.2012. Now, the petitioner has been relieved on 22.3.2017 by the respondent No.5 without any authority of law.
Learned counsel for the petitioner submits that he has already represented to the District Basic Education Officer, but no orders have been passed. The Institution in question is a Primary School run by the Basic Education Board. As such, the Basic Education Officer is the competent authority to look into the matter.
The writ petition is disposed of with the direction that the respondent No.3-District Basic Education Officer will look into the matter and pass appropriate orders, as far as possible, within a period of one month from the date a certified copy of this order is presented before it.
