Heard learned counsel for the petitioner and learned Standing Counsel for State-respondents.
The petitioner has come before this Court for return of original mark-sheet and certificate of High School examination, which required some correction.
According to the petitioner, some correction was required in the mark-sheet and certificate and as it was not timely provided to the petitioner, the petitioner had made a claim before the District Consumer Forum at Deoria under the provisions of Consumer Protection Act. On 27th February, 2009, District Consumer Forum found the Principal of the institution concerned responsible and accordingly directed the institution concerned to provide amended certificate as also compensation.
It appears that Principal of the institution did not comply with the order passed by the District Consumer Forum and therefore this petition was filed.
It is not in dispute that during the pendency of those proceedings, the mark-sheet and certificate has been provided to the petitioner. However, this Court, by order dated 13th November, 2017, had required the Secretary, Secondary Education, U.P., Lucknow to conduct an enquiry.
Pursuant to the order dated 13th November, 2017, the Board conducted an enquiry and an affidavit of compliance has been filed by Sandhya Tewari, Special Secretary Education, Government of U.P., Lucknow annexing therewith enquiry report. The enquiry report indicts the Principal of the institution and is consistent with the finding returned by District Consumer Forum. Accordingly, no further action is required in this matter. The petition is consigned to record.
