Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This is the second bail application on behalf of the applicant. The first bail application was rejected by Hon'ble Harsh Kumar, J. (s he then was) on 13.02.2019 on merit.
Learned counsel for the applicant submits that during the trial three witnesses of fact have been declared hostile. However, statement of the Investigating Officer is still not recorded. He prayed that this application be dismissed as withdrawn with an appropriate order to expedite the trial.
As prayed, the present bail application is dismissed as withdrawn.
However, the trial court concerned, is directed to take all endevour to conclude the trial of S.T. No. 53 of 2018 arising out of case crime no. 1502 of 2017 under section 302 I.P.C., police station Quarsi, District Aligarh as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order.
