JUDGMENT / ORDER

Matter pertains to dealership of an Oil Company viz., Bharat Petroleum Corporation Limited (BPCL).
2. The prayer in the writ petition is in a narrow compass. It is for issuance of a mandamus to the third respondent to dispose of a representation dated 28.9.2016 given by the writ petitioner V.Akbar.
3. Learned counsel appearing for all the three respondents would say that the writ petitioner is not a dealer of BPCL and therefore, there is no privity of contract between the petitioner and BPCL.
4. It is also brought to the notice of the court that the prayer in the writ petition is for transferring the dealership of the writ petitioner's younger son in favour of his elder son on account of some incapacity on the part of the younger son.
5. Be that as it may, I am not going into those aspects as in the light of the submissions made on behalf of BPCL, now, the learned counsel for the petitioner undertakes to have a representation sent by the petitioner's younger son (A.Syed Shajahan), who is admittedly a BPCL dealer, buttressing and supporting the representation dated 28.9.2016 given by the writ petitioner. The learned counsel for the writ petitioner undertakes that this would be done within a period of two weeks from the date of receipt of a copy of this order.
6. On receipt of such buttressing/supporting representation from Syed Shajahan, the third respondent-BPCL is directed to dispose of the said representation dated 28.9.2016 alongwith the buttressing supporting representation from the petitioner's youger son, in a manner known to law, within a period of four weeks from the date of receipt of the buttressing representation, as aforesaid. The main writ petition is disposed of on the above terms. No costs. The connected miscellaneous petition is closed.
