This writ petition was filed to direct the respondents to pay the compensation amount as per Award No.7/91-2000 dated 27.03.2000 passed by the second respondent for an extent of 4.20 acres immediately relating to the land in Survey Nos.151/2A, 151/2B, 151/2C, 151/2D, Veppur Hamlet of Olaipadi, Kunnam Taluk, Perambalur District of the total extent of 2.55 hectares (6.30 acres).

The learned Government Advocate appearing for the respondents 1 and 2 has filed a counter affidavit wherein it is stated that originally the writ petitioner had not filed any document to prove his title over the acquired lands in question and hence the compensation for the lands has been kept under the Revenue Deposit on 11.04.2001. Now that the petitioner who filed this writ petition originally, had expired and his legal heirs have been brought on record as petitioners 2 to 5. Reiterating the averments made in the counter, the learned Government Advocate submitted that the petitioners 2 to 5 as well as the third respondent have to prove their interest on the joint holdings in respect of the property in question and if they do so, the compensation kept under the Revenue Deposit shall be released.

In view of the above stated circumstances, this Court is of the view that it is for the petitioners 2 to 5 and the third respondent to produce the relevant documents to the authorities to prove their holdings, for reimbursement of the compensation kept in the Revenue Deposit. With this observation, the writ petition is closed. No costs.
