JUDGMENT / ORDER

The petitioner seeks for issuance of a Mandamus directing the respondents to forthwith consider his application for gun licence in License No.180/1 FLR in favour of the petitioner for further period as may be prescribed under the Act and Rules.
2. The petitioner retired from the Army services as Havildhar on 30.09.2009. According to the petitioner, during the course of his service in the Army, he was granted gun licence by a proceedings dated 23.11.2009 and it was periodically renewed till 09.02.2015. For renewing the gun licence, the petitioner submitted an application on 28.01.2015 and he was called upon for an enquiry on 06.02.2015. The petitioner also participated in the enquiry before the first respondent. At the time of enquiry, as it was represented that the petitioner is working as Revenue Inspector in the office of the District Collector, Vellore, by a proceedings dated 21.02.2016, the first respondent sought certain clarification from the Revenue Divisional Officer, Vellore. In response, the first respondent received a reply dated 02.03.2016 stating that there is no objection for renewal of the Arms licence bearing No.180/PLR in favour of the petitioner. According to the petitioner, inspite of such No Objection given by the Revenue Divisional Officer, Vellore to the first respondent, the first respondent has not so far processed the application of the petitioner seeking renewal of gun licence. The petitioner also sent a representation dated 28.11.2016 to the first respondent reiterating his request to pass orders on the application seeking renewal of gun licence, but no order has been passed thereon. The petitioner has therefore come forward with this writ petition for the relief stated above.
3. I heard the learned counsel for the petitioner as well as the learned Special Government Pleader appearing for the respondents. Admittedly, the application submitted by the petitioner on 28.01.2015 is pending on the file of the first respondent as on date. Therefore, without expressing any opinion on merits, the first respondent is directed to consider the application dated 28.01.2015 of the petitioner for renewal of his gun licence and to pass orders thereon on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
4. With the above direction, the writ petition is disposed of. No costs.
