(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Pursuant to order dated 09.01.2012, counsel for the appellants stated that appellants have deposited a sum of Rs. 14,66,532/- before the Trial Court on 24.01.2012.
Having heard learned counsel for the parties, we direct that 25% of the amount deposited by the appellants be released in favour of respondent Nos. 1 and 3 in proportion of 75% and 25% respectively by account payee cheque after due verification. Remaining 75% of the amount shall be deposited in any nationalized bank of the choice of the said respondents initially for a period of five years. Such deposits shall be renewed from time to time till final disposal of the appeal. Respondent Nos. 1 and 3 shall not be allowed to withdraw such fixed deposits nor shall be allowed to create any charge thereon or take loan on the basis of such deposits. The receipts of the deposits be kept with the Registry of the trial court. Said respondents, however, will be entitled to receive periodical interest accruing on such deposits in the same proportion, as provided hereinabove.
Civil Application is disposed of accordingly. Rule is made absolute to the aforesaid extent.
