This application under Section 482 Cr.P.C. has been filed by the applicant to quash the entire proceedings of Case No. 2823 of 2015 (Mithlesh Kumar vs. Smt. Urmila Pandey), under section 138 of Negotiable of Instruments Act, 1881 pending before the Additional Chief Judicial Magistrate, Court No.10, Allahabad.
The sole relief prayed by learned counsel for the applicant at the time of argument is to direct the court below, i.e., Additional Chief Judicial Magistrate, Court No.10 Allahabad to decide the Case No. 2823 of 2015 (Mithlesh Kumar vs. Smt. Urmila Pandey) under Section 138 of Negotiable of Instruments Act, 1881, expeditiously, within a time bound period.
Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it, as expeditiously as possible, without granting unnecessary adjournment to any of the parties. Therefore, the court below is directed to make all possible efforts to decide the aforesaid case as expeditiously as possible, without giving any unnecessary adjournment to either of the parties provided that there is no legal impediment.
With the aforesaid direction, this application is finally disposed of.
