We have heard Shri Devesh Kumar Verma, learned counsel for the petitioner; Shri Prashant Singh, learned counsel for the Union of India and Shri Neeraj Dube, learned counsel for the National Highway Authority of India.
The petitioner is before this Court with request to issue direction to the second respondent, Arbitrator/Additional Commissioner (Administration), Kanpur Division, Kanpur to decide the Arbitration Case No.C-201803000003637 (Urmila Devi vs. Presiding Officer and others) filed under Section 3G (5) of National Highway Act, 1956 within stipulated time.
Learned Additional Chief Standing Counsel fairly states that in case the aforesaid arbitration case is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to expedite the proceeding of the aforesaid arbitration case and decide the same, if possible, within a period of three months from the date of production of a copy of this order before him.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the applicants alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
