Heard learned counsel for the applicant and learned Standing Counsel for the respondents.
Instructions so received by learned Standing Counsel are taken on record. On 17.4.2017 following order was passed:-
"On instructions, learned Standing Counsel states that the order of the writ Court dated 4.4.2016 passed in Writ A No. 13731 of 2016 has already been complied with and the entire payment due has been deposited in the bank account of the petitioner on 31.3.2017.
Learned counsel for the petitioner prays that he may be granted time to verify the same. On his request, put up as a fresh case on 19.4.2017."
Operative portion of the order of the Writ court dated 4.4.2016 is quoted as under:-
"Considering the facts and circumstances of the case a direction is issued upon the fourth respondent to consider the grievance of the petitioner and pass an appropriate order in accordance with law expeditiously, within three months from the date of communication of this order."
Today learned counsel for the applicant states that about Rs. 3000/- and odd less has been paid to the applicant and interest has also not been paid.
Learned Standing Counsel states that the order of the Writ court dated 4.4.2016 has been complied with and grievance of the applicant has been redressed and it is not in dispute that an amount of Rs. 79,631/- has already been deposited. According to the petitioner the amount payable is Rs. 82957/-.
In such view of the matter, the order is substantially complied with. In case the petitioner has any grievance on merits, she may approach the appropriate forum/court for redressal of her grievances.
However, learned Standing Counsel is directed to supply a copy of the instructions so received to Sri P.K. Sinha, learned counsel for the applicant.
Present contempt application is consigned to record.
