Sri Abhishek Dwivedi, learned Advocate has put in appearance on behalf of Sri Ashish Mishra. He prays for and is granted liberty to make correction in the prayer clause of the present petition.
The prayer made in the present petition is to issue a direction to the court below to decide the application under Order IX, Rule 13 moved on 1.10.2014 which is registered as Misc. Case No. 338 of 2014 in Original Suit No. 1113 of 2012.

Be that as it may, without entering into the merits of the claim made by the petitioner, the present petition is being disposed of with the direction to the court below namely the Civil Judge (Senior Division), Gautam Buddh Nagar to decide Misc. Case No. 338 of 2014 pending in Original Suit No. 1113 of 2012, expeditiously, preferably within a period of three months from the date of submission of certified copy of this order, without granting any unnecessary adjournment to any of the parties, after giving due notice and opportunity to all the parties concerned.
