Heard Mr. Sujit Kumar Rai, learned counsel for the petitioner, Mr. P.P. Yadav, learned counsel for respondent no. 2 and Mr. Ramanand Pandey, learned Addl. Chief Standing Counsel for respondents-State.
The principal prayer made in the writ petition reads thus:
“i) issue a writ, order or direction in the nature of mandamus, directing the Election Officer, respondent no. 4 not to permit the members enrolled after 30.10.2017, the date on which the term of the elected committee of management has been expired, to participate in the election of the society in question.”
We are not inclined to entertain the prayer, as made in the writ petition, on two grounds, firstly, the members enrolled after 30.10.2017 are made party to the petition. Even after we so expressed, counsel for the petitioner does not seek leave to add them as party-respondents in the writ petition. Secondly, the stage of raising objection for inclusion or deletion of names from the voters' list has yet not reached.
The petition is, accordingly, dismissed.
