The petitioner has preferred the present writ petition with the prayer to direct the respondents to issue appointment letter to the petitioner and to pay salary by month to month as and when due.
Preliminary objections have been raised by Sri Jitendra Kumar Singh, learned Standing Counsel representing respondent No.1 as well as Sanjay Chaturvedi, learned counsel put his appearance on behalf of respondent No.2/District Basic Education Officer, Ballia that appointment letter could only be issued by the Manager of the Institution in question. A further objection is also raised that the relief sought by the petitioner is against the Committee of Management which is a private party and as such, the writ petition is not maintainable under Article 226 of the Constitution of India.
After the aforesaid objections, counsel for the petitioner made a prayer for dismissal of the present writ petition as not pressed.
Prayer made by the learned counsel for the petitioner is allowed.
The writ petition is dismissed as not pressed.
