JUDGMENT / ORDER

Serious allegations are made in respect of appointment of respondent no. 6-Dr. Kishorilal S. Agrawal. It is the say of the petitioner that it is illegal appointment made against the rules and guidelines framed for direct recruitment. It is the say of the petitioner that the representations made on 18th March 2013 and 4th February 2014 to the Gujarat Vigilance Commission, Government of Gujarat have not been paid any heed to. It is the say of the petitioner that appointment of respondent no. 6 to the post of Asstt. Professor in Department of Chemical Page 1 of 2 C/SCA/6939/2015 ORDER Engineering, Faculty of Technology & Engineering, M.S University, Vadodara at the age of 58 years is made with an oblique motive and in complete disregard to the existing rules and regulations.
Learned advocate Mr. Dhruv K. Dave appearing for the petitioner has urged that from the time the respondent no. 6 was appointed, the petitioner has been attempting to approach the authorities bringing out the true facts of the said illegal appointment. It is his say that when young candidates are available and when the requirement of the age for the post of Lecturer/Professor is thirty five years; with relaxation of five years for SC/ST candidates, appointment of somebody at the fag end of his retirement requires intervention.
Issue notice to the respondents, returnable on 7th May 2015. Learned Assistant Government Pleader Mr. Niraj Ashar waives service of notice for and on behalf of respondent no. 1. Direct service is permitted.
