1. By this application, the applicant seeks restoration of Civil Revision Application No.1103/1999 which came to be dismissed for want of prosecution as the learned advocate for the applicant was not present when the matter was called out.
2. Heard Mr. N.S. Shevade, learned advocate for the applicant, Mr. A.R. Thacker, learned advocate for the respondents and Mr. Mihir Bhatt, learned Assistant Government Pleader for the respondent No.2.
3. Having regard to the averments made in the application, the court is of the view that the applicant has sufficiently explained as to why the learned advocate for the applicant could not remain present when the matter was called out. In the circumstances, the application is allowed. Civil Revision Application No.1103/1999 is hereby restored to file. Rule is made absolute accordingly with no order as to costs.
