1. Rule.
Mr.Shushil Shukla, learned advocate waives service of notice of Rule on behalf of the respondent herein.
2. In the facts and circumstances of the case and with the consent of the learned advocates appearing on behalf of the respective parties, the present application is taken up for final hearing today.
3. The present Civil Application has been preferred by the applicant herein
- original plaintiff for fixing early date of hearing of the main Second Appeal No.232 of 2009.
4. Having heard learned advocates appearing on behalf of the respective parties and subject to filing the paper-book by the appellant within a period of two months from today, the present application is allowed and Registry is directed to notify the main Second Appeal No.232 of 2009 for final hearing in the week commencing from 16th July,2012. Rule is made absolute to the aforesaid extent.
