Heard Sri Shiv Sagar Singh, learned counsel for the applicant and Sri Pankaj Mishra, learned AGA appearing for the State and perused the record.
The present anticipatory bail application has been moved on behalf of the applicant with prayer to enlarged him on bail in Case Crime No.0252 of 2019, under Sections 147, 148, 149, 332, 323, 353, 504, 506, IPC, Police Station Lalkurti, District Meerut.
The contention of the counsel for the applicant is that applicant has been falsely implicated in the present case; that the matter needs deeper and fairer investigation before any arrest should be given effect to; that the applicant is willing to participate and cooperate with the investigation. Therefore, the applicant may be enlarged on anticipatory bail.
Learned AGA appearing for the State has very strongly opposed the prayer for anticipatory bail, and placed reliance upon the statement of the victim under Section 164 Cr.P.C., hence the applicant is not entitled for anticipatory bail.
Having heard the counsel for the parties, looking to the nature of allegation, the FIR and statement of the girl under Section 164 Cr.P.C and also the gravity of the offence, no case for grant of any indulgence in anticipatory bail application has been made out.
Accordingly, the present anticipatory bail application is hereby rejected.
