Order on Time Extension Application No. 3 of 2018.
Sri Vinay Kumar Tripathi, learned counsel for the opposite party no.2 is not present though copy of the time extension application has been served to him on 02.05.2018.
Heard Sri Sachindra Mishra, learned counsel for the applicants and Sri G.
P. Singh learned A.G.A. for the State.
Learned counsel for the applicants submits that this Court vide order dated 18.03.2016, had rejected the prayer for quashing of proceedings of the case with respect to the applicant nos.1, 2 and 3, but during the pendency of the said application, the applicant no.3, Suraj Bind died who was suffering from some mental ailment and applicant no.1 and 2 were engaged for treatment of applicant no.3, hence the applicant nos.1 and 2 could not surrender before the Court concerned in compliance of the Court's order dated 18.03.2016.
Learned counsel for the applicants prays that the interim order may also be extended because due to non-disposal of the time extension application, the matter was kept pending before this Court, hence the interim order may continue till the next date of listing.
Taking into account the averments made in the affidavit filed in support of the time extension application, two weeks and no more further time is granted to the applicant nos.1 & 2, namely, Umakant Bind and Bharat Bind, to surrender before the court concerned in compliance of the Court's order dated 18.03.2016.
Let the case be listed before the appropriate Bench in the next cause list. Interim order, if any, shall continue till the next date of listing.
Accordingly, the time extension application is disposed of.
