The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 20.11.2017 passed in Writ C No.54782 of 2017. The operative portion of the order is reproduced hereinbelow :-
"The writ petition is disposed of with a direction to the respondent no.3-A, Tehsildar, Tehsil- Soraon, District Allahabad, to decide / dispose of Case No. 423, (Gaon Sabha Vs. Rishikesh and others), as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits."
Affidavit of compliance was filed. It is stated in the affidavit that the order passed by the writ court has already been complied with and decision has been taken on 5.2.2018, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed. However, in case applicant is still aggrieved it is open for the applicant to approach the appropriate forum, if so advised.
