Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioner is before this Court for a direction to the Civil Judge (Junior Division), District - Auraiya to decide the application (6C) filed by the plaintiff/petitioner in Original Suit No. 88 of 2019 (Usha Tiwari vs. Vijay Kumar & others).
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to the court below to consider and pass appropriate orders on the injunction application filed by the plaintiff/petitioner on the next date fixed in the matter. However, if on account of any reason, the injunction application is not taken up on the said date, the court below shall make all endeavour to decide the injunction application within next three months, after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
