Today, the case is listed peremptorily, even then the learned counsel for the revisionist has sent his illness slip.
This revision is directed against the judgement and order dated 24.8.2009 of acquittal passed by Additional Sessions Judge, Court No.7, Saharanpur in Criminal Appeal No. 28 of 2008, whereby the court below has set aside the order of conviction dated 25.8.2008 passed by Additional Chief Judicial Magistrate, Court No. 19 Saharanpur in Criminal Case No. 2156 of 2004 and convicted the opposite party Nos. 2 to 5 under Section 147, 354, 323 I.P.C.
Appellate court has considered the judgement of the trial court and the material on record. It has considered the allegations and the evidence on record regarding the offences alleged under different Sections. The appellate court has recorded the findings that from the material on record, the alleged offences are not made out and medical report has not supported the prosecution case. The contradictions in the testimonies have been examined. A perusal of the judgement of the appellate court shows that it has rightly set aside the order of conviction passed by the trial court. The order of the appellate court does not calls for any interference.
The Criminal Revision stands dismissed.
