Heard Ms. Usha Kiran, learned counsel for the appellant and Sri Vinod Kumar Singh, learned counsel for the respondent and perused the record.
The valuation of the present appeal is Rs. 26,200/- only. There is a Government Order dated 13.10.2016, according to which the departments have been directed not to contest the case on the ground of smallness of valuation wherein the liability is below Rs. 2 lakhs.
In such view of the matter, I am not inclined to entertain the present appeal due to smallness of the amount.
Present appeal is accordingly dismissed on the ground of smallness of the amount.
However, it is made clear that dismissal of the present appeal shall not come in way of the Corporation to contest the appeal of higher valuation or to contest the appeal that may be filed for enhancing the amount by any of the claimants.
