Heard learned counsel for petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"i). issue a writ, order or direction in the nature of mandamus directing the respondent No. 2 to decide the Case No. T2018024220504376 of 2018 (Usha Devi Vs. Munna Lal and others) Under Section 116 of U.P. Revenue Code, 2006 within stipulated period which is pending before the Court of Sub Divisional Magistrate, Tehsil-Chayal, District Kaushambi/respondent No. 2 (Annexure No.1 ot this writ petition)."
It is stated by the counsel for the petitioner that a partition suit instituted by him is pending consideration since the year 2018.
Perusal of the order sheet of the proceedings filed along with the writ petition reveals that no written statement has been filed. Therefore, the issues have not been framed neither parties have led their evidence In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Sub Divisional Magistrate (in short 'SDM'), Chayal, Kaushambi to consider and decide the case expeditiously, preferably within a period of 18 months from the date of production of a certified copy of this order before him.
