T.Saramma vs The Government Of Puducherry

Madras High Court|08 March, 2017

JUDGMENT / ORDER

Seeking a direction to the fourth respondent to proceed under the Right To Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for fixing of compensation for lands acquired under G.O.Ms.No.66 dated 18.08.2006 situated at Ward C, Block No.9, Kovilpathu Village, measuring an extent of 68.40 ares belonging to the first petitioner and 3.95.56 hectares belonging to the second petitioner, the present writ petition has been filed.
2.The one and only grievance of the petitioners whose lands have been acquired by the second respondent pursuant to G.O.Ms.No.66 dated 18.08.2006 is that after coming into force of the new enactment viz., Right To Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, such compensation required to be paid will have to be quantified under it and thus not the earlier one under which the acquisition has been made.
3.Learned Additional Government Pleader appearing for respondents 1 to 4 submits that there is no difficulty in complying with the provisions of the new Act by fixing the compensation payable to the petitioners, the rules are yet to be given effect to and therefore, as and when it is done, the compensation will be quantified under the new Act and in terms of the Rules.
4.The abovesaid statement made by the learned Additional Government Pleader appearing for respondents 1 to 4 is hereby recorded. After the Rules come into force, respondents 1 to 4 shall quantify the compensation under the new Act and the Rules within a period of 12 weeks thereafter.
5.With the above observation, the writ petition stands disposed of. No costs.
