Civil Misc. Amendment Application No. NIL of 2019:
By means of this amendment application, the petitioner has prayed that the application under Order XXXIX Rules 1 and 2 C.P.C. be also decided.
The application is allowed. Learned counsel for the petitioner may incorporate the necessary amendments during the course of the day.
Order on the petition:
The record reveals that the Suit is pending since 2018. The defendants have also filed their written statements in the suit.
Under such circumstances, it is being directed that the application for temporary injunction be decided within a period of three months from the date of presentation of a certified copy of this order. Further the suit itself be decided after framing of issues etc. as expeditiously as is possible.
The writ petition is, accordingly, disposed of.
