Heard Sri P.K. Singh, learned counsel for the petitioner and Sri Ashish Pandey, learned A.G.A. for the State and perused the material available on record.
This writ petition has been filed with a prayer to ensure the presence of the petitioner to attend the marriage and other ceremonies of his one and only Son scheduled from 11.5.2018 to 13.5.2018 in police custody as petitioner is detained in S.T. No. 91 of 2010 (State Vs. Tribhuvan Singh) arising out of Case Crime No. 98 of 1991, under Sections 147, 148, 149, 307 and 302 IPC, P.S. Bhawarkol, District Ghazipur.
The present application has been filed by the petitioner for releasing him on short term bail on the ground that his son's marriage has to be performed on 11.5.2018, hence, he had moved an application before the trial court and the same has been rejected against which the present petition has been preferred.
Learned A.G.A. has raised preliminary objection regarding maintainability of the prayer and learned counsel for the petitioner tried to rule out the preliminary objection raised regarding the maintainability of the same.
We are not inclined to interfere in the matter as the present petition is not maintainable.
The prayer made in the present petition is wholly mis- conceived, hence, this writ petition is dismissed.
