Heard Shri Vipul Pandey, learned counsel for the petitioner and Sri Sanjai Singh, learned counsel for the respondents.
Against the notice dated 02.02.2019 issued by the Bank under Section 13(4) of the SARFAESI Act, 2002, the petitioner has statutory remedy of approaching the Debts Recovery Tribunal under Section 17 of the aforesaid Act.
It is open to the petitioner to take recourse to the remedy available to him under the Act.
We are not inclined to interfere in the matter at this stage.
The writ petition is accordingly dismissed on the ground of alternative remedy.
