Torrent Power Ltd & vs Yashvantkumar Dahyabhai ...

High Court Of Gujarat|22 April, 2015

JUDGMENT / ORDER

Considering the fact that Special Civil Application No.10126 of 2014 arising from the same incident is already admitted by an order dated 8.8.2014, to avoid multiplicity of work and different decision in different matter, it would be appropriate to take care of this matter with such Special Civil Application No.10126 of 2014. However, considering the fact as pointed out by learned advocate Mr.Mukesh Rathod for the respondent No.1, appearing through caveat, that employee is already superannuated in the year 2011, thereby he being a senior citizen, it would be appropriate to decide the matter at the earliest. Therefore, rule, returnable on 4.8.2015 for final disposal of the matter. Mr.Mukesh Rathod, learned advocate waives service of rule for respondent No.1. List this matter along with Special Civil Application No.10126 of 2014. It is ordered that during the pendency of this petition, the impugned award/order passed by the Labour Court/Industrial Court, shall remain stayed.
